Battery Waste Management Rules, 2022

The Battery Waste Management Rules, 2022, notified by the Ministry of Environment, Forest and Climate Change (MoEFCC), establish a comprehensive framework for handling battery waste in India.


These rules emphasize Extended Producer Responsibility (EPR), ensuring that waste batteries are collected, refurbished, or recycled in an environmentally sound manner. The Central Pollution Control Board (CPCB) serves as the primary regulatory body, overseeing EPR implementation, registration, and compliance monitoring for producers.




Application

These rules shall apply to:


  1. Producer: An entity who is engaged in either manufacturing, sale or import of battery including refurbished battery including in equipment, under its own brand produced by other manufacturers or suppliers.

  2. Consumer: End user of battery 

  3. Entities involved in collection, segregation, transportation, re-furbishment and recycling of Waste Battery;

  4. All types of batteries regardless of chemistry, shape, volume, weight, material composition and use.




Validity

The validity period of EPR Registration certificate is of 5 years from the date of issuance by the CPCB. This period provides stability for businesses to plan and execute their waste management strategies without frequent disruptions.




Renewal

The renewal must be initiated at least 60 days before the certificate’s expiry The CPCB reviews and renews the certificate, provided there are no outstanding compliance issues.




Registration Process


1. Access the CPCB EPR Portal

Visit the official Central Pollution Control Board (CPCB) EPR Battery Registration Portal and initiate the producer registration process using valid corporate credentials under the Battery Waste Management Rules, 2022.


2. Furnish Producer Details

Complete the online application form with accurate corporate information, including registered office address, authorised signatory details, and category-wise data on batteries placed in the market during the preceding financial year.


3. Upload Statutory and Compliance Documents

Submit duly attested copies of mandatory documents such as Certificate of Incorporation, GST Registration, PAN, Board Resolution/Authorisation Letter, and technical specifications of the battery products and various other details


4. Formulate and Submit the EPR Implementation Plan

Prepare a structured Waste Management Plan outlining mechanisms for collection, channelisation, and recycling of end-of-life batteries, supported by agreements or MoUs with CPCB-registered recyclers to ensure traceable compliance.


5. Application Scrutiny by CPCB

The CPCB conducts a detailed technical and legal assessment of the submitted application and accompanying documents. Any discrepancies, data inconsistencies, or missing information may lead to queries or rejection, requiring professional rectification within a prescribed timeframe.


6. Grant of EPR Authorisation

Upon successful verification and approval, the CPCB issues the EPR Battery Registration Certificate specifying the validity period, target obligations, and reporting conditions under the national EPR framework.


7. Post-Registration Obligations

Registered producers must operationalise their collection and recycling network, maintain verifiable transaction records, and file periodic returns evidencing compliance with assigned collection and recycling targets through the CPCB portal.

3. Maintenance of Records

Keep systematic and verifiable records of quantities of batteries placed on the market, collected, and recycled, along with EPR certificates purchased or redeemed.


4. Submission of Annual and Periodic Returns

File mandatory returns on the CPCB portal detailing collection, recycling performance, and target fulfilment within prescribed timelines.


5. Fulfilment of EPR Targets

Meet assigned annual collection and recycling obligations as specified in the registration certificate, supported by valid recycler acknowledgments or EPR credits.


6. Renewal of EPR Registration

Apply for renewal of the EPR Certificate at least 60 days before expiry, ensuring continued compliance and uninterrupted business operations.


7. Adherence to Reporting and Audit Requirements

Cooperate with CPCB audits or inspections and furnish documentary evidence of compliance when required.
